PRIVACY NOTICE

National Development Bank Limited (“we” or “us” or “our”) is a statutory body created in terms of the National Development Bank Act. We care about the enjoyment of your right to privacy. We collect, store, and use information that identifies you, which is otherwise known as personal data on various instances to achieve specific purposes which we will disclose to you. We respect your choice and autonomy with respect to information that identifies you, therefore we will be always transparent and open to you  
This notice is for you. It is meant to appraise you on why we have to collect your personal data, on what lawful ground, who we may share it with, what your rights are, if we transfer it outside of Botswana and how to contact us regarding matters concerning your privacy and data protection. 

THE PERSONAL DATA THAT WE COLLECT

Most of the personal data that we collect is collected directly from you. You give us this personal data when you complete the forms you are given to populate for any product or service you solicit from us (such as loan application forms). Some of your personal data is collected indirectly from other organisations (such as credit rating agencies, portals for supporting enhanced customer due diligence), through a contact person of a company or any juristic person and through video surveillance by CCTV when you visit our branches and offices. 

THE PURPOSE OF COLLECTING THE PERSONAL DATA

We collect personal data which is relevant and strictly necessary for the purpose that has to achieved. We have specified the various instances where we must collect your personal data. We are required by law, to inform you not only about the purpose of processing but also about the lawful ground for processing.

THE RECIPIENTS OF YOUR PERSONAL DATA&

We may share your personal data with:
•    Regulatory authorities or law enforcement as required by law.
•    Third-party service providers engaged by the Bank for the provision of our services and for facilitation of marketing of our products.

 

YOUR RIGHTS

 

You have the right to:
•    Access and request a copy of your personal data.
•    Request correction of any inaccurate information.
•    Object to the processing of your personal data under certain circumstances.
•    Where applicable, request us to transfer your personal data to another organisation.
•    Where applicable, restrict the processing of your personal data
•    Where applicable, object to automated decisions that are solely made without human intervention.
•    Where applicable, delete your personal data.  

TRANSFER OF PERSONAL DATA

We may transfer your personal data to countries outside Botswana. When we do so we prioritise countries that have been recognised by the Minister and/or Commission as having protections that are essentially equivalent to the protections under the data protection laws of Botswana. We will, in limited instances, send to countries that may not have the same level of data protection as Botswana. When we do so, we will rely on appropriate safeguards or derogations that are available at law.
